Why buyers check so carefully

Land in Ghana can be sold twice, sold by someone who doesn't own it, or caught up in a family or stool dispute. Careful buyers ask for the indenture, the site plan and a Lands Commission search before they pay. A seller who has these ready sells faster and at a better price.

Who needs to sign

That depends on the type of land: the owner for individual land, family representatives for family land, and the stool or state process for stool and state land. Consents take time, so start early, and use a lawyer to prepare the indenture and register the sale.

Buyers can set out their offer with the offer letter.

  • Ghana: registering a sale

The Lands Commission asks for a stamped instrument naming the parties and witnesses, a solicitor’s seal, an approved site plan signed by a licensed surveyor and the Director of Survey and Mapping, an executed oath of proof, consent for stool and state land, and the transferor’s original land certificate for transfers.

  • Ghana: consolidated search

For a consolidated search, the scanned site plan must be edged pink or red, drawn to a standard scale, with the grid visible.

  • Ghana: who must signNot yet verified

Who signs depends on the land: the owner for individual land, the family head with principal members for family land, and the stool occupant with principal elders for stool land. Spousal consent may also be needed. Confirm with a lawyer.
